In May 2024, the Obligations of managers of land or infrastructure (Urban stormwater management and On-site wastewater management) (the OMLI) was gazetted. The OMLI contains obligations relating to the management of urban stormwater and on-site wastewater.

Urban stormwater can present a cumulative risk of harm to the environment and human health. This is particularly the case without appropriate strategic and long-term planning and management to prevent harm and minimise risks. Clause 5 of the OMLI sets obligations for councils in Victoria to complete this strategic and long-term planning.

Clause 5 of the OMLI requires councils, in consultation with relevant stakeholders, to develop a plan that identifies risks posed by stormwater and actions to address those risks. This is a continuation of the same requirement under the now expired State Environment Protection Policy (Waters). The OMLI also has a requirement to publish, review and update the plan and report on implementation at least every five years.
